Tests to prove gay asylum seekers are telling the truth about their sexuality break EU law

Psychological tests on gay asylum seekers to ‘prove’ their sexuality break EU law, the European Court of Justice ruled today.

Hundreds of gay people from Africa, the Middle East and Chechnya have claimed asylum in the EU on the basis that they would be persecuted in their home countries.

Today’s ruling, which follows a similar decision in 2014, sets a precedent which should be observed in all 28 EU member states, including Britain.

Judges in Luxembourg said that basing an asylum decision solely on the result of a psychological evaluation broke EU law because their infringed on the human right of privacy and dignity.

Today’s decision concerned an appeal by a Nigerian man against a Hungarian decision to deny him asylum. The claim was rejected after psychological tests did not prove he was gay.

The European Court of Justice (ECJ) clarifies points of EU law for national courts and is the highest court in the bloc. The case will now be dealt with by the Hungarian court, which must take the EU judges’ decision into account.

The asylum seeker’s case to stay in Hungary is likely to be strengthened by today’s judgement, although Budapest has taken an infamously hard line on migration.

The European Commission is suing Hungary in the ECJ for refusing to take in its share of refugees under the EU’s mandatory migrant relocation quota scheme.

In 2014 EU judges made a similar ruling about a case in the Netherlands and the ECJ ruled in 2013 that people who had been jailed for homosexuality in their home country could claim asylum in the EU.

Last year, the Home Office released data that showed that, over a two year period, more than two-thirds of the 3,535 asylum seeker applications involving sexuality. Theresa May was Home Secretary at the time of the decisions.

The Home Office was criticised in 2017 after it brought in new rules that would send gay Afghans back to Afghanistan, where homosexuality is illegal and “wholly taboo”.

Home Office guidelines say that claimants should “establish to a reasonable degree of likelihood” of their sexuality, and that a person’s declared sexuality should be taken as a “starting point” in a case.

The guidelines tell interviewers to avoid asking “prurient questions” about sexual preferences or physical attractiveness. But investigations in 2014 found that those rules were being flouted and Mrs May ordered a review.

Man Utd interest in Grealish wanes after Aston Villa survival

Man Utd and other clubs wanting to buy Jack Grealish will have to pay more after Aston Villa avoided relegation from the Premier League, according to Sky Sports.

Villa drew 1-1 with West Ham on the last day of the season to secure their safety after Watford lost to Arsenal.

Villa’s survival means a potential Grealish transfer will cost teams like Man Utd and Tottenham more as the Midlands club can afford to keep their star player.

Grealish has been their talisman this season, registering eight goals and six assists in 36 games.

The 24-year-old England international has been heavily linked with a big money move to Manchester United in recent months, although this could now be called off.

It’s thought a deal taking him to Old Trafford could cost more than £80 million, which is likely to put off the likes of Ed Woodward.

United recently spent £68 million on fellow playmaker Bruno Fernandes. And with forwards Anthony Martial, Marcus Rashford and Mason Greenwood all in good form, the club might not be able to afford another attacking signing, especially in the current market.

This means the Villa captain is likely to be playing under Dean Smith again next season in a side that will be aiming to improve on their 17th place finish.

They are currently linked with Werder Bremen winger Milot Rashica and Brentford’s Said Benrahma, who would bolster Smith’s attacking options and provide Grealish with plenty of support.

Rashica is set to leave Bremen after a disappointing season for the club where they narrowly escaped relegation. The player was in good form, however, scoring eight and assisting seven in 30 Bundesliga appearances.

Benrahma will be a target for numerous Premier League sides if Brentford miss out on promotion via the play-offs. They finished third in the Championship and are scheduled to play Swansea today after losing the first leg 1-0.

 

Bayern Munich set asking price for Liverpool and Man Utd target

Bayern Munich have set their asking price for Thiago Alcantara amid reports Liverpool and Man Utd are interested in his signature.

Reports from Germany last Thursday, this time in Munich-based newspaper Abendzeitung claimed that Thiago ‘sees his future’ at Liverpool with Klopp believing that the Spaniard would provide him with the ‘missing piece of the puzzle’.

Jurgen Klopp was asked about the speculation on Saturday, to which he replied: “I have no idea who will play for me next year, there is nothing to say at the moment.

“Thiago Alcantara is a great player, but also a Bayern Munich player. That’s actually all there is to say. There’s nothing to say!”

Man Utd have also been linked with Spanish newspaper Sport claiming earlier in July that Thiago was ‘about to leave Bayern Munich and sign for Manchester United.’

And now Sport Bild claims that the Bundesliga giants have set their asking price with the report claiming that the Spaniard ‘will only be released when the transfer is 30 million euros’.

Sport Bild adds that ‘further squad planning’ at Bayern depends on the money they receive from sales of players such as Thiago and Corentin Tolisso.

Meanwhile, Bayern CEO Karl-Heinz Rummenigge recently confirmed that they intend to cash in on Thiago, to avoid losing him on a free transfer next summer.

“We had serious negotiations with him and fulfilled all of his wishes. But it looks like he might want to do something new again at the end of his career,” Rummenigge told Bild.

“We don’t want to lose a player for free next year. I say that very clearly.”

 

Arsenal are ‘best placed’ to sign former Liverpool superstar

Arsenal are leading the race to sign Philippe Coutinho from La Liga side Barcelona, according to reports in Spain.

Spanish publication Sport brought us the news on Tuesday that Kia Joorabchian – who represents Coutinho – ‘has been negotiating in recent weeks’ over a possible return to the Premier League.

And Mundo Deportivo journalist Miguel Rico (via Sport Witness) claims on Wednesday that the Gunners are ‘best placed’ to sign the Barcelona playmaker.

The latest report backs up what Sport said on Tuesday that Joorabchian has been ‘working for months’ to try and take Coutinho to Arsenal.

They describe his agent’s relationship with Arsenal head of football Raul Sanllehi as ‘great’ which has led to rumours that Matteo Guendouzi could be used as part of any deal for Coutinho.

Barcelona are not willing to let Coutinho leave on loan and will consider ‘money and only money’ for the Brazilian and negotiations are continuing with Arsenal.

Paul Merson has warned Jurgen Klopp that Liverpool must dip into the transfer market this summer or risk being caught by their Premier League rivals.

Manchester City and Manchester United are both expected to add to their squads this summer, while Chelsea continue to be linked with a number of Europe’s top talent having already acquired the services of Hakim Ziyech and Timo Werner.

And Merson claims the Premier League champions will find it difficult to retain the Premier League title if they do not spend for the second successive summer window.

The pundit has referenced how the wheels fell off for Mauricio Pochettino at Tottenham, a process he claims started when they did not improve their XI following two of Spurs’ best-ever Premier League seasons in 2015/16 and 2016/17.

“Spurs had a similar situation under Pochettino a couple years ago.

“They had such a good XI, that anyone they bought wasn’t likely to play much.

Wanting to face Brock Lesnar for the WWE Universal Championship:

“Listen, I don’t shy away from a fight for one second and I would absolutely love to be in there with Brock Lesnar. I would love to get in there with The Undertaker and Triple H, too, these are guys that have been active at the top of the game for the last 20 years. They’re the type of guys I want to be in the ring with. We talk about stepping up and taking things to the next level, and I think that’s what I need to do next. Once I handle Bray Wyatt, I need to be going after the Universal Championship which I was never beaten for. Yes, Brock Lesnar is the current champion, but make sure you don’t forget that I relinquished the title due to injury, I was never beaten, and I definitely think that I deserve a title shot.”
How a match with Lesnar would be:
“For me as a fan growing up I loved David vs Goliath style matches. Right now, there’s a lot of interesting matches that could happen in WWE right now, but for me personally I think that Finn Balor vs Brock Lesnar is the most interesting match from a fans perspective that can happen right now. It’s something that has never happened before, with completely different styles inside and out of the ring. This could be a really big spectacle.”
