All You Need is Love»…

Will Smith crée l’événement à Paris

From enlargement to agriculture

From enlargement to agriculture

Updated

Joost Korte has been appointed a deputy director-general of the European Commission’s agriculture department, with effect from 1 January.

As one of four deputy directors-general in the department, he will take responsibility for the economics of agricultural markets, direct support and market measures.

Korte, a Dutch national, is currently deputy director-general in the Commission’s department for enlargement, a post he took up in January 2012. In 2009-11, he was a director responsible for relations with the Council of Ministers in the Commission’s secretariat-general, where he also worked as a head of unit (2008-09) and adviser (2007-08).

In 2004-07, he was head of the private office of Danuta Hübner when she was commissioner for regional policy, and in 2002-04 deputy head of the private office of Chris Patten, the commissioner for external relations. A lawyer by background, Korte joined the Commission in 1991 following eight years of academic work on European law.

Catching the energy wave

Catching the energy wave

The Commission wants to revive interest in harnessing the power of the seas

By

Updated

The idea of deriving energy from the movement of the waves or the turning of tides has been around for decades, yet these are still considered emerging technologies. Now the European Commission has come up with a strategy amied at permitting ocean energy to make a significant contribution to Europe’s energy mix.

Wave and tidal power were both selected for development in the initial enthusiasm for renewables following the oil crisis of the 1970s, but in the mid-1980s public support dried up. “There was a very clear hiatus and there were a number of pioneers who kept the sector going throughout Europe on very little,” says Sian George, who heads Ocean Energy Europe, an umbrella body for the sector.

As climate change rose higher on the political agenda, policymakers again showed interest in ocean energy, and from 2000 public funding began to flow again. But private investment faltered. “We have seen a degree of risk fatigue and investment fatigue on the part of the private sector, compounded by the crisis, hard investment times and the total withdrawal of the venture-capital sector from any high-risk, high capital proposition,” says George.

This situation – a promising group of technologies stalled at the demonstration and deployment stage – is what the Commission sets out to address in its communication on ‘blue energy’ released on January 20. This covers wave and tidal power, along with more complex approaches such as ocean thermal energy conversion and salinity gradient power. The aim is to create a clear, stable and supportive policy framework that will attract investment to ocean energy and develop its potential. The Commission draws a parallel with offshore wind power and believes that the potential for ocean energy is comparable.

Its main initiative is the establishment of an Ocean Energy Forum, bringing the sector together with other marine industries. This is intended to help develop a strategic roadmap for the sector, setting out clear targets for its industrial development. This in turn could be the basis for a European Industrial Initiative, hosting large-scale technology development projects.

While the creation of a talking-shop might seem timid, it is exactly what the sector wants. “Here is an opportunity to share knowledge between different member states, facilitated by the Commission,” says George. “This is exactly the kind of thing that the Commission should be doing.”

She feels that the forum will be crucial in getting public authorities to share experience in removing administrative barriers to ocean energy, such as licensing and consenting procedures, and also for comparing market incentives. Similarly, there is a need to co-ordinate technology development, closing a gap that has opened up between industry’s priorities and those currently receiving support from EU programmes.

The industry is also looking for a serious conversation on investment, both to fill the funding gap for early-stage, high-risk demonstration projects, and also for getting private equity into small and medium-sized enterprises.

EU moves to protect trade secrets

EU moves to protect trade secrets

Commission to propose a minimum level of protection for confidential information.

By

Updated

The European Commission will next week propose legislation to combat industrial espionage and cyber-crime by increasing protection for trade secrets.

Michel Barnier, the European commissioner for the single market and services, is to unveil a draft law proposing a minimum level of protection across the European Union for companies’ confidential information.

The proposal will be welcomed by companies whose commercial advantage relies on keeping secret information about their processes and products. They include large-scale chemical manufacturers as well as small businesses – among them tyre-manufacturers and makers of fragrances. For them, patent protection – which involves making public the detail of innovations – is not an option.

The Commission will propose to define what know-how can be protected as a trade secret and set out specific legal remedies that must be made available, such as injunctions and damages, when that secrecy is breached.

At present, definitions of trade secrets vary across the European Union’s member states.

According to Sarah Turner, a specialist in the law of intellectual property at Hogan Lovells, a law firm, in some member states of the EU, the law on trade secrets is “almost non-existent”.

In some member states, problems arise because taking a digital copy of trade secrets does not fall within the legal definition of theft.

In 2012, a French fragrance company, IPRA France, accused two ex-employees of photocopying recipes for perfumes and lists of clients, but its claims were rejected because the original documents had not been stolen.

In Belgium, it is difficult for a company to litigate over a trade secret without making its content public.

The tyre-maker Michelin was left without a legal remedy when an employee in France went to the UK and tried to sell information on suppliers and production plans to competitors.

The UK is considered to offer a high-level of protection for trade secrets, partly because claimants find it relatively easy there to obtain search warrants, which are helpful when a company is seeking to establish its case.

Pierre Sivac, president of the International Fragrance Association, which has been urging the Commission to propose legislation, said: “The enforcement of the protection of know-how is exceedingly difficult because of inconsistent regimes across EU member states. He said that a bold proposal from the Commission would “go a long way to ensuring that innovative European industries, such as the fragrance industry, remain competitive”.

The association has long argue that patent protection and copyright are not enough. Not all trade secrets would qualify for patent protection. Others are not patented because of the cost involved or because they are too valuable to a company’s business model to be made public.

The association argues that companies feel better protected in the US and Japan, than in Europe, because those countries have stronger rules on protecting trade secrets.

BusinessEurope, the European federation of employers’ organisations, last month sent a letter to Karel De Gucht, the European commissioner for trade, and to Michael Froman, the US trade representative, calling for them to use negotiations on a free-trade agreement to co-ordinate their approaches to protecting trade secrets.

Council’s rejection of EU pay rise was justified, says ECJ

Council’s rejection of EU pay rise was justified, says ECJ

In a surprise judgment, the European Court of Justice in Luxembourg has ruled that the European Union’s Council of Ministers was legally entitled to refuse a 1.7% salary increase for European Union staff that the Commission proposed in 2011.

By

Updated

The Court on Tuesday (19 November) ordered the Commission to make a new proposal that takes into account the serious and sudden deterioration in economic conditions in the Union – the justification given by the Council in December 2011 for its rejection of the salary rise. The court’s judgment runs – unusually – counter to a legal opinion delivered in September by Yves Bot, an advocate general at the court.

The Commission each year proposes adjustments to the salaries and pensions of EU staff, employing a formula that tracks developments in the purchasing power of national civil servants in eight member states. This method, agreed with trade unions representing EU staff, is intended to ensure that EU salaries are roughly in line with those of national officials, and the Commission says it lacks the power to propose figures lower than those produced by the formula.

But in 2009 and 2011, the Council rejected the Commission’s proposal, on each occasion with different outcomes. In 2009, the member states refused to approve a 3.7% pay rise, which led to a court challenge against the member states by the Commission. The ECJ ruled in November 2010 that the Council had exceeded its powers in blocking the Commission’s proposal – it had

offered a 1.85% rise instead – and that the Council’s only margin of discretion over salary adjustments was to trigger an exception clause in case of a “serious and sudden deterioration in the economic situation” in the EU. In rejecting the 2009 rise, the Council had not invoked the clause; the court upheld the Commission’s complaint and the increase was paid.

The Council learned from its mistake and, in rejecting the 2011 increase, it invoked the exception clause. The Commission disputed the Council’s assessment of the economic conditions, and both sides brought their case to the ECJ. The ruling establishes that it was the Council’s task, not the Commission’s, to determine whether the economic environment justified triggering the exception clause – thus making it possible to block salary rises. The court also ruled that once that determination has been made, the Commission is obliged to make a new proposal based on the exception clause.

The ruling has limited implications beyond the 2011 salary rise. From 1 January 2014, new rules apply to staff pay, pensions and perks, limiting any move – up or down – in staff salaries to 2% a year, and, in times of crisis, imposing further limits to any increases in pay. Moreover, salaries have been frozen this year and next. The crisis clause has been made more automatic, so that disputes over who has the power to trigger it should be a thing of the past.

Günther Lorenz of the Union Syndicale, a staff union at the Council, said that staff were “shocked” by the judgment, which he described as “legally very difficult to understand” and “a primarily political ruling”. He said that the staff unions made their concessions to the member states on the staff reform on the assumption, shared by everyone, that the court would again side with the Commission. He called on the Commission again to propose a 1.7% rise for 2011.

Man Utd loanee banned for six games after alleged biting incident

The young stopper denied violent conduct, but the Football Association has announced he has received a significant ban

Manchester United’s on-loan goalkeeper Kieran O’Hara has been banned for six matches following an alleged biting incident during Burton Albion’s draw with Peterborough United.

The 23-year-old, who is on a season-long loan with League One side Burton, clashed with Peterborough forward Sammie Szmodics at a corner, with an image appearing to show O’Hara biting his opponent’s arm.

O’Hara was charged by the Football Association (FA) and despite denying his behaviour amounted to violent and/or improper conduct, a commission found him guilty of the charge and handed him the suspension along with a £2,500 fine.

More teams

A statement from the FA read: “An independent regulatory commission has suspended Kieran O’Hara for six matches with immediate effect and fined him £2,500 for a breach of FA Rule E3.

“The Burton Albion FC goalkeeper denied that his behaviour during the 44th minute of an EFL League One fixture against Peterborough United FC on Saturday 29 February 2020 amounted to violent and/or improper conduct but the charge was subsequently found proven.

“The independent regulatory commission’s written reasons will be published in due course.”

O’Hara is yet to feature for United’s first team but has played twice for the Republic of Ireland at international level.

He joined the Red Devils as a 16-year-old in 2012 after making the move from his local club Urmston Town.

The Manchester-born stopper has joined a swag of clubs on loan including Trafford, AFC Fylde, Morecambe, Stockport County, Macclesfield Town and Burton Albion.

O’Hara has two caps for the Republic of Ireland – who he qualifiers for through his paternal grandparents.

His senior debut came as a substitute in a friendly against Bulgaria in September last year and made his first start two months later against New Zealand in another non-competitive match.

Manchester United already have a wealth of goalkeepers on their books with David De Gea the current number one and Argentina international Sergio Romero as his back-up.

They also have former Stoke City stopper Lee Grant on their books, while Dean Henderson is starring on loan at Premier League high flyers Sheffield United and Joel Pereira is on a temporary move at Hearts.

Bruce delights in display of ‘frightening’ Everton target

Steve Bruce is certain Everton target Allan Saint-Maximin has a “bright future” after his late strike secured a 1-0 win for Newcastle over 10-man Southampton at St Mary’s.

The Magpies had failed to score in their last four top-flight outings and the pressure was increased after Matt Ritchie missed a penalty in the first half.

But Saint-Maximin’s 79th-minute strike ended that goal drought as Newcastle moved eight points clear of the drop zone.

And Bruce is confident there is much more to come from the French forward, who was linked with Everton at the weekend.

(Sorry for linking to The Sun. Don’t buy it.)

“I’m delighted for him, I’ve said since day one he’s always going to please everybody,” Bruce said.

“If you haven’t seen him play then you’re going to enjoy watching him because he is a natural footballer, which don’t come around too often like that.

“He’s got frightening pace and great balance and got that thing where he wants to beat you and we don’t see that too often anymore.

“It can be a bit frustrating at times and he has to learn, but if he learns he’s got a big, bright future ahead of him.”
