MEPs consider tightening rules on mining companies
Transparency also asked of oil, gas and logging industries.
Transparency in the financial operations of European oil, gas, mining and logging companies will be the main focus of a vote in the European Parliament’s legal-affairs committee on Tuesday (18 September) on reporting requirements in extractive industries.
A proposal from the European Commission would oblige multinational firms to report annually and country by country on payments they make to foreign governments, especially in developing countries, where many of these resources are located. The aim of the measure, presented by Michel Barnier, the European commissioner for internal market and services, is to deter corruption and tax evasion.
But the text foresees an exemption under which companies would not have to report when to do so would violate local criminal law. Companies in the extractive industry are seeking to broaden this exemption, so it covers civil law as well.
Transparency campaigners describe the exemption as a loophole that would encourage governments in the developing world to adopt legislation outlawing disclosure. The campaigners received a boost last month when the US Securities and Exchange Commission (SEC) issued its final rules implementing the Dodd-Frank act, adopted by the US Congress in 2010. Dodd-Frank does not provide for an exemption, and the SEC has rejected industry claims that exemptions are necessary, in an echo of campaigners’ warnings. For the SEC, conformity with local law is a matter for contract negotiations between extractive firms and foreign governments.
The Commission’s proposal, which takes the form of an amendment to the EU’s transparency directive of 2004, broadly followed the Dodd-Frank act. The intention was that, taken together, the two pieces of legislation would create a de-facto global standard for transparency in the extractive industries.
Arlene McCarthy, a centre-left British MEP who is in charge of steering the draft legislation through the Parliament, has cautioned that the Barnier proposal consequently presents “a risk of a fragmented response to transparency”. Eloise Todd, the director of the Brussels office of ONE, an anti-poverty campaign group, said: “The SEC was clear: project-by-project reporting and no exemptions in the US law. The Parliament can now reset the debate in Europe and help create a strong global transparency standard by endorsing equally strong EU legislation.”
Two other deputy DG posts filled and three agencydirectors named.
The European Commission has recruited an outsider to be a deputy director-general in one of its departments – an unusual move in an institution that still usually promotes from within its own ranks. The college of European commissioners yesterday (25 July) approved the appointment of Roberto Viola, currently the secretary-general of Italy’s regulator for the communication industries (Agcom), to be one of the two deputies to Robert Madelin, who heads the directorate-general for communication networks, content and technology (the department, which was previously information society and media, was renamed on 1 July).
Viola, who holds a doctorate in electronic engineering, has chaired the Commission’s Radio Spectrum Policy Group, and was an official in the European Space Agency in 1985-99.
Viola’s starting date has not yet been agreed. The post has been vacant since Antti Peltomäki switched departments in February to become a deputy director-general for enterprise and industry.
The Commission yesterday filled two other deputy director-general posts that have lain vacant for 19 months – in the department for development aid, DG Devco. The department was formed from the merger in January 2011 of those parts of the directorate-general for development that did not go into the European External Action Service and the EuropeAid Co-operation Office.
The vacancies, which were created by the departure to the EEAS of the previous deputy director-general for development and by the retirement of Richard Weber, the deputy director-general of EuropeAid, are both being filled by the promotion of directors from the merged department and will take effect on 1 August.
Klaus Rudischhauser, currently director for quality and impact, will be deputy director-general co-ordinating the department’s policy work. Like Fokion Fotiadis, the director-general, he came from the pre-merger DG Development. Marcus Cornaro, currently director for the neighbourhood countries, will be deputy director-general in charge of the department’s geographic programmes. Rudischhauser is German and Cornaro is Austrian so there will be two native German-speakers immediately beneath Fotiadis, in a department that has a strong contingent of officials from the EU’s Mediterranean member states.
Agency posts
Among other appointments made yesterday, Florika Fink-Hooijer, the head of the private office of Kristalina Georgieva, the commissioner for international co-operation, humanitarian aid and crisis response, has been appointed director for strategy, policy and international co-operation in the department for humanitarian aid (DG ECHO) with effect from 16 September. The German national has worked in the private office of Monika Wulf-Mathies, was a head of unit for Japan, Korea, Australia and New Zealand, and worked in the secretariat-general.
Jean-Louis De Brouwer, a Belgian, has been appointed director of humanitarian and civil protection operations in DG ECHO. De Brouwer, who has been with the Commission for 30 years and whose previous posts were in the field of migration and asylum, is currently director for Europe 2020 employment policies in the department for employment, social affairs and inclusion. The date of his transfer remains to be determined. All three director posts in the department under Claus Sørensen, the director-general, are now filled.
Gilbert Gascard, a Belgian, has been appointed director of the Commission’s Research Executive Agency (REA) in Brussels, with effect from 1 November. He has been director of the Education, Audiovisual and Culture Executive Agency (EACEA) since 2005.
Pablo Amor, a Spaniard, has been appointed as director of the European Research Council Executive Agency in Brussels (ERCEA), with effect from 1 August. Amor currently heads the agency’s grant management department.
Maria Betti of Italy has been appointed director of the Institute for Environment and Sustainability at the EU’s Joint Research Centre in Ispra, Italy. Betti joined the Commission in 1991 and is currently on secondment to the International Atomic Energy Agency (IAEA).

“But let’s not forget that in pre-season, if they had a board meeting and a chat to say we’re going to get knocked out of all the cups but win the Premier League, every single one of them would have voted for that.
“They would have all accepted it, so it’s not a bad season at all. It’s just surprising when you look at, if you hadn’t seen a game of football all year and look at their last five or six fixtures, that’s the surprising chapter in their season.”

They will, however, be disappointed to have slipped out of Europe at the last-16 stage, with defensive errors having undermined their efforts when coming unstuck against Atletico.
Johnson added on that setback: “I can’t remember the last time someone scored three goals at Anfield, let alone beat them.
“The first goal is a terrible error from the keeper [Adrian] and it is what it is, but the defending afterwards was terrible. It was on the other two goals as well.
“It’s like they’ve thought ‘we’ll let them shoot because they aren’t going to score anyway’. That was the surprising bit.
“They [Atletico] have gone there with a game plan, scored three goals and people are saying they are super-defensive. If that’s defensive…”
West Ham vice-chairman Karren Brady thinks the current Premier League season should be declared “null and void” if the season can’t be finished due to the coronavirus outbreak.
The Football Association, the Premier League, the English Football League, FA Women’s Super League and FA Women’s Championship have all agreed to call a halt to competitive action with immediate effect until early April.
Liverpool are only two wins away from winning the Premier League title, while other teams have relegation and European qualification issues if the season is ultimately cancelled.

And Brady says the “only fair and reasonable” thing to do would be to declare the whole season “null and void”.
“Suspension or cancellation of the league was always a certainty,” Brady wrote in The Sun.
“There is no dodging the possibility that all levels in the EFL, as well as the Premier League, will have to be cancelled and this season declared null and void because if the players can’t play the games can’t go ahead.
“The PL hopes that an interlude of three weeks from today will enable it to restart but that may well be dreamland.
“So what if the league cannot be finished? As games in both the PL and in the EFL are affected, the only fair and reasonable thing to do is declare the whole season null and void.
“Who knows who would have gone down or come up if the games have not actually been played in full?
“A huge blow to Liverpool who might be robbed of their first title in 30 years.
“This will be discussed between the PL and the clubs next week at an emergency meeting.”

Spanish newspaper Marca claim Jurgen Klopp ‘belittled’ Diego Simeone ahead of Liverpool’s shock Champions League defeat to Atletico Madrid.
The Reds boss admitted he was a “bad loser” after complaining about Simeone’s tactics at Anfield, as Atletico overcame Liverpool 3-2, 4-2 on aggregate.
The comments flew under the radar initially in Spain, with the press focussing on another excellent victory for Atletico.
But Marca changed tack on Friday, with a piece looking into how Simeone added Klopp to a list of great managers he has got the better of, according to Sport Witness.
They pointed to Klopp’s joke when the draw was made: “I don’t think Simeone is running around his living room happily.”

And claimed that this comment came back to bite him.
Apparently, the ‘triumphal’ Liverpool manager did ‘not contemplate’ just how difficult it would be to overcome Simeone and Atletico, who have done it before ‘against opponents with better players’.
Klopp therefore ‘belittled’ Simeone, to his and Liverpool’s cost.

The plane crash that killed footballer Emiliano Sala was caused by the pilot losing control while attempting to avoid bad weather, accident investigators said.
A final report by the Air Accidents Investigation Branch (AAIB) concluded that the single-engine Piper Malibu aircraft suffered an in-flight break up while being flown too fast for its design limits.
It added that pilot David Ibbotson, 59, was probably affected by carbon monoxide poisoning.
Investigators found that a contributory factor in the crash was Mr Ibbotson having no training in night flying and a lack of recent practice in relying only on cockpit instruments to control a plane.
Argentinian striker Sala, 28, signed for Cardiff City from French club Nantes on January 19 2019 for £15 million.
Mr Ibbotson flew him from Cardiff to Nantes so he could say goodbye to his former team-mates later that day, before conducting the fatal return flight two days later when the plane plunged into the Channel.
Sala’s body was recovered but Mr Ibbotson has not been found.
Neither Mr Ibbotson nor the plane was licensed for the flight to operate commercially but evidence showed he was to be paid a fee, the AAIB said.
Unlicensed charter flight operations – known as grey charters – generally incur lower operating costs.
Former football agent Willie McKay has said he paid for the fatal flight but did not choose the pilot or the plane.
He has explained he was helping his son Mark, who was acting for Nantes, to complete the transfer.
Alison Campbell, senior inspector for operations, said it was a dark night with “little or no” visible horizon.
“There was poor weather in the area, and from his radio calls, it was clear the pilot needed to manoeuvre to avoid it,” she explained.
Following a descent of thousands of feet in a matter of seconds, the pilot attempted an “abrupt nose-up” manoeuvre.
This was conducted at a speed far in excess of the design limits of the plane, causing it to break-up.
Investigators concluded that the aircraft entered the Channel upside down, and the impact was “not survivable”.
The AAIB also revealed that the pilot informed a number of individuals about four potential problems with the aircraft that had occurred during the outbound flight from Cardiff.
This included a “bang”, although its cause is unknown and it could not be determined if it was a factor in the crash.

Scottish football has announced an immediate suspension, with all games – including Sunday’s Old Firm derby – postponed until “further notice”.
The Scottish Football Association and Scottish Professional Football League’s joint response group have decided to call a halt to action in the wake of the coronavirus crisis.
Rangers were due to stage champions-elect Celtic but the Ibrox clash has now been shelved.
Friday night’s meeting between Motherwell and Aberdeen plus four other top-flight fixtures across the weekend also face being re-arranged.
The Championship showdown between Queen of the South and Ayr is also off, along with the rest of the lower league card.
In a statement, the joint response group said it had been decided to suspend “all domestic professional and grassroots football under the jurisdiction of the Scottish FA until further notice”.
It added: “The Scottish FA and SPFL will continue to liaise with governments and UEFA in relation to domestic, European and International fixtures in the coming days and more information will be communicated at the appropriate time.
“The Scottish FA Board made its decision in the interests of the health and safety of players, match officials, staff, supporters and the general public.”
SFA chief executive Ian Maxwell said: “Since the guidance outlined by governments last night we have been engaged in extensive dialogue to clarify the position and implications of that guidance for Scottish football.
“Today’s announcement is made in the interests of public health but, equally, the health and safety of players, match officials, and staff across the game. This is of paramount importance as the country enters the ‘delay’ phase of the coronavirus pandemic.
“It is also why the Scottish FA is compelled to ensure that the suspension is cascaded through the non-professional and grassroots games until further notice.”
His SPFL counterpart Neil Doncaster added: “As everyone knows, this is a fast-moving and unprecedented situation for the entire country.
“We have been in intensive and detailed discussions since last night and have also been taking on board the experience of our counterparts in England and across Europe.
“As a result, the board of the SPFL has agreed this morning that all league fixtures this weekend and next midweek will be postponed until further notice.
“The health and safety of fans, players and officials is absolutely paramount. We have not yet had any confirmed cases of coronavirus amongst players in Scotland, but, given the nature of this outbreak, it seems only a matter of time.
“We realise that many people will be bitterly disappointed, and we would obviously prefer to be in a position where we can continue as normal, but that’s neither realistic nor possible.”
First Minister Nicola Sturgeon announced on Thursday that the Scottish Government was advising that events attracting crowds of more than 500 people should be cancelled as of Monday.

L’univers des salles obscures a décidé de mettre en lumière le sort des sans-papiers. Une nouvelle campagne du Collectif Des Cinéastes Pour Les Sans-Papiers débute ce lundi soir avec la projection d’un court pour attirer l’attention sur ce long combat.
Comme l’explique le site collectifdescineastespourlessanspapiers.com, quelque 350 cinéastes ont déjà signé ont l’appel « Nous les prenons sous notre protection » pour soutenir les travailleurs sans papiers en grève de la rue du Regard (Paris 6e, ndr) : cet appel qui ne concernait pas que les cinéastes, répondait à l’urgence de ne pas laisser les grévistes sans papiers menacés d’expulsion dans leur isolement” et de poursuivre: « Dans le même temps, face à l’indifférence des médias et des politiques, rendant invisible cette grève qui dure déjà depuis plus de quatre mois et touche plus de 6000 travailleurs sans papiers, nous avons décidé, comme certains d’entre nous l’avions déjà fait avec Nous, Sans-Papiers De France en 1997 et Laissez-Les Grandir Ici, en 2007, de réaliser un nouveau film, dont le titre reprendra le slogan des travailleurs sans papiers en grève: On Bosse Ici! On Vit Ici! On Reste Ici! ».
Ce Collectif Des Cinéastes Pour Les Sans-Papiers, présentera donc ce lundi soir à Paris un court-métrage de 3 minutes sur les grévistes en lutte pour leur régularisation. Une séance militante présidée par Laurent Cantet, Palme d’Or au festival Cannes en 2008, Catherine Corsini, Robert Guédiguian, Tony Gatlif, Bertrand Tavernier ou encore Jacques Audiard. Rendez-vous est fixé à 18h à la Cinémathèque de Paris, avant une projection en plein air sur place.
Déjà couronnée quatre fois aux César, la comédienne a reçu une cinquième statuette samedi dernier pour son rôle dans La Journée De La Jupe. Un record. A cette occasion, elle a choisi Gala pour une interview sans chichi. Amours, engagements, audaces, mademoiselle Adjani ne connaît pas la langue de bois.
La légende veut que les grandes stars du cinéma soient déconnectées du quotidien. La légende veut qu’Isabelle Adjani soit une artiste mystérieuse, inaccessible et hors du temps. Ce matin-là, la femme qui se tenait face à moi en train de boire son thé, avec un gros bonnet de laine sur la tête, allait me prouver qu’il ne faut pas croire les légendes urbaines. Matinale (on l’est forcément quand on est mère de famille), connectée à la société… la comédienne parle d’une voix douce mais ses mots sont cash. C’est peut-être à cela qu’on reconnaît les vraies légendes… celles du cinéma: elle n’ont plus peur de rien et surtout pas de dire les choses!
Gala : Vous êtes la seule à avoir été couronnée cinq fois en tant que meilleure actrice aux César. Comme les légendes du sport, les comédiennes aussi peuvent-elles être associées à des records ?
: Recevoir un César a une vraie signification, celle de la reconnaissance, mais en même temps ces quatre César ne définissent ni ce que je suis ni ce que je fais. Mais vous parliez de record… il y a un revers à la médaille. Nous sommes en France et chez nous, le premier de la classe n’a pas toujours bonne presse. Les Américains adorent se congratuler entre eux. Nous, non! Il m’est arrivé d’entendre des actrices dire: «J’espère que je ne vais pas avoir le César, parce qu’on ne va plus rien me proposer.» Le comble, non? Quand vous êtes récompensé, vous vous distinguez. Sans le vouloir, vous vous désolidarisez de la grande famille. Vous êtes perçu comme faisant cavalier seul.
Gala : En 1995, vous n’êtes pas venue chercher votre César récompensant votre interprétation de la reine Margot. Pourquoi? I. A. : J’étais enceinte de sept mois et demi, j’avais peur qu’on se focalise sur mon ventre rond, d’autant que j’allais devenir une maman seule. Je n’avais pas le cœur d’affronter cela. Aujourd’hui, cela aurait fait de jolies photos pour Gabriel-Kane. Tant pis. (Sourire).
Gala : Cette cérémonie est une caisse de résonance. Quelques années plus tôt en 1989, vous aviez été récompensée pour
Claudel. Vous aviez lu un extrait des Versets sataniques de
… Auteur qui était frappé par une fatwa. I. A. : Cette cérémonie est une tribune exceptionnelle, ce serait dommage de l’ignorer. L’ignorer, ce serait finalement la sacrifier. Nous sommes en direct avec le public, il n’y a pas de contrefaçon possible. C’est l’un des rares moments médiatiques où il peut se produire quelque chose qui ne soit pas convenu. Ce que les gens ont parfois du mal à entendre des politiques, ils le ressentent et le comprennent grâce aux artistes. A condition bien sûr d’être crédibles et légitimes.
Gala : Si tout le monde partageait votre point de vue, les soirées des César seraient plus animées.
I. A. : Attention je ne critique absolument pas ceux qui montent sur scène et disent: «Merci, je ne sais pas quoi dire, je n’ai rien préparé.» On a aussi le droit d’être pris par l’émotion, dans la modestie et la timidité. Il faut bien se rendre compte que ce moment qui vous consacre est un choc. Pour moi aussi, malgré les apparences, mais tout le parcours d’une actrice est un traumatisme. Déjà à la base. J’ai passé toute mon enfance et mon adolescence à entendre: «Ne te fais pas remarquer!» J’ai bien raté mon coup! Ce traumatisme est devenu positif et, au cours des années, m’a donné l’élan, l’énergie de la prise de parole. Je me sens une responsabilité, le devoir de m’exprimer, je n’y peux rien!
Gala : Et que répondez-vous à ceux qui vous rétorquent de vous mêler de ce qui vous regarde?
I. A. : A ceux-là, je leur fais un bras d’honneur! C’est démodé de dire cela, aujourd’hui on est tous engagés, sinon on n’existe pas et on ne fait rien exister. Je fais partie des gens sur lesquels on compte. Je ne vais pas faire comme si ce n’était pas le cas. J’aurais alors l’impression de trahir les valeurs que je veux partager avec la société dans laquelle je vis.
Gala : Cette année vous êtiez nommée pour votre rôle de prof dans La Journée De La Jupe. Un film bouleversant sur la discrimination des femmes en banlieue. Dans ce film, les ados surnomment cette prof «Boulette», en référence à une chanson de Diams. Que pensez-vous du choix de cette artiste de se produire désormais voilée sur scène? I. A. : Je suis atterrée et profondément désolée; Je ne la connais pas. Je trouve qu’elle a un talent fou et je ne comprends pas ce qui lui arrive. «Se voiler la face» provient peut-être d’une grande détresse. Le problème, c’est que cette détresse peut être contagieuse.
Gala : Cette Journée De La Jupe est un nouveau départ pour vous. Vous l’avez dit. Ce rôle casse aussi littéralement votre image d’héroïne romantique, tourmentée…
I. A. : Mais pour moi, être actrice c’est aussi l’art de la métamorphose! Vive la chute des icônes, vive la chute des icônes romantiques!
Gala : Avez-vous vu la caricature qu’avait faite de vous Florence Foresti? Elle était dans cet esprit. Votre personnage était hors du temps et il répétait sans cesse «Je ne suis pas folle, vous savez?»
I.A.: J’adore! Irrésistible! je lui avais d’ailleurs laisser un message où je rentrais dans son jeu. C’était tendre de sa part. Elle voulait dire: «Elle ne fait peut-être pas tout comme vous vous voulez, mais pourquoi on le lui reprocherait?» J’aime sa dérision, car je me tourne en dérision moi-même chaque jour. Il faut chasser le spleen, j’ai longtemps cherché à être comprise, aimée, protégée, j’ai fini par comprendre que cela était juste impossible et je n’avais qu’à m’en charger moi-même.
Gala : Comment l’avez-vous compris?
I. A. : M’affranchir de toute cette souffrance vécue pendant l’enfance, c’est passé pour moi par une analyse. Un beau jour vous lâchez prise et vous faites le deuil de tout un fatras de choses qui vous pourrissait la vie.
Gala : Parlons d’enfance. Est-ce facile d’être les enfants d’Isabelle Adjani ?
I. A. : Ce n’est jamais facile d’être le fils ou la fille de. Pour mon grand fils, qui est musicien, je crois que c’est un encombrement plus qu’autre chose.
Gala : Vous avez déclaré avoir un âge intime qui ne coïncide pas avec votre état civil. Quel âge intime avez-vous Isabelle? Celui d’une adolescente rebelle? I. A. : Si mon fils vous entendait… Il ne faut pas exagérer! Si vous voulez vraiment savoir, il y a des moments où je n’ai pas encore passé le cap de la crise de la trentaine! En tout cas, je ne me suis jamais aussi bien sentie de ma vie et je commence à m’amuser.
Gala : Dans les prochains mois, vous allez tourner et coproduire un film dans lequel vous jouerez la rédactrice en chef d’un magazine people. Comprenez-vous qu’il y ait des gens pour lire ce type de magazines?
I. A. : Je ne les achète pas, mais quand je tombe dessus, je les feuillette. On a tous une curiosité de midinette! Je comprends que ces magazines rencontrent un vrai succès, surtout auprès des jeunes qui se cherchent des modèles de réussite. Pour autant, il ne faut pas confondre l’intrusif et la transparence. Ces magazines sont voyeuristes sous prétexte de vérité toute crue.
Gala : Vous avez souvent été transparente justement. Notamment quand vous avez parlé de l’infidélité de votre ancien compagnon dans L’Express. Pourquoi ce choix?
I. A. : Plus que d’infidélité, il s’agissait du thème du harcèlement moral. Je l’avais fait pour ne pas tomber malade et puis si ma démarche pouvait rendre service à quelques dizaines de femmes… Je suis très proche de toutes les causes féminines. Si des hommes ont pu me le reprocher, too bad! La révolte me rend un peu radicale, je le concède.
Gala : Au fil des années, vos mésaventures amoureuses ont aussi forgé cette image d’héroïne romantique dont nous parlions tout à l’heure.
I. A. : Même avec un cœur romantique, sincèrement, je me serais bien passée de toutes les histoires d’amour qui font du mal. Elles ne seront jamais des moteurs de création à mes yeux. Je ne fais pas partie des artistes qui idéalisent le désespoir ou la solitude. Comme dit mon plus jeune fils: «Le prochain, il faudra lui faire passer un vrai casting!»
Gala : Vous avez fait l’actualité ces derniers jours pour des raisons moins artistiques. Vous avez prêté une grosse somme d’argent à l’homme avec lequel vous viviez et que vous avez quitté depuis.
